Letter to Secretary of Transportation / Safety Fitness Determination Rule-making
 
We were part of a 9 member coalition which submitted a letter to the new Secretary of Transportation Elaine Chao and important Senators and Congressmen seeking the termination of the FMCSA's Safety Fitness Determination Rulemaking. Attached is a copy of that letter.
 
It is important to note that a total of 61 associations including shipper groups, OOIDA, and ATA joined in this request. Clearly, the industry is becoming united in its rejection of SMS methodology and the Agency's past unyielding efforts to enforce systemically unvetted new safety rules on our industry. This is a good first step at reining in bureaucratic overreach in the name of safety.
 
Left to be dealt with is the virulent attack on the independent contractor status of owner-operators under state and federal labor laws and plaintiff bar’s efforts to obtain nuclear judgments using negligent selection and vicarious liability theories to target shippers and brokers.
